Reclaiming Aqua Card Charges

In 2010 I was in financial meltdown due to my gambling addiction and defaulted on all my Loans, Credit Cards and Payday Loans. I could no longer sustain the huge debt hanging over me. A result of this is that I also ended up getting a load of charges added onto my accounts. In the first of my financial clean up posts I am going to write about my Aqua Card Charges and what I am doing to get them back.

Charges and Interest

Between February 2010 and September 2010 Aqua Card charged me a total of £180 in over limit and late payment fees and £432.63 in interest despite me explaining my financial difficulties.

I have now also written a letter which you can see below. It is nothing special, my next one will be  a lot better when I get the usual sorry but no refund can be given reply from Aqua Card. Here is my letter.

Dear Sir or Madam,

I write with reference to the above account number. I am writing to request a refund of all the charges and interest shown on the enclosed spreadsheet.

In March 2010 I contacted Aqua regarding my financial difficulties and I am surprised that I was punished so harshly with the charges and interest applied.

I also sent you a letter earlier on this year querying the execution of the default notice to which I have not received a reply. I have enclosed this letter as well and would be grateful if you can answer the questions I raised.

Please send me details of your complaints procedure.

My previous letter to Aqua Card never got a reply. Instead they stopped Moorcroft Debt Collection from collecting the debt and sold it to a company called Lowell. How suspicious that I complain and Aqua sell the account? Luckily for me Lowell obtained the copy statements I needed to total up all the charges I received. Dear Sir or Madam,

I write with reference to the above account number and I would be grateful if you could provide me with some information relating to the account.

According to my records, I received a default notice dated 11th August 2010 which stated that I should remedy my Breach of Contract before the 1st September 2010. However on the 25th August 2010, I received a letter stating that I had failed to repay the requested amount despite there still being 7days left. Can you explain how that works?

I also note that the default date reported by Call Credit and Equifax is incorrect on the above basis. Please amend the Credit Reference Agencies with a correct default date of August 2010. Currently both Equifax and Call Credit report October 2010 as the date of default.

I would also like to ask if you could provide me with a complete list of charges applied to this account since it was opened including charges added by Albion Collections who were collecting this account.

Finally, please could you tell me how much interest has been charged to the account since I notified Aqua of my inability to pay in March 2010?

So there you have it, that’s where I am up to at the moment with getting back my Aqua Card charges. I will let you know when I hear back and what my next course of action is going to be.
